Nora Ephron, marriage and divorce's most prominent commentator, dies at age 71

A post about a filmmaker may not seem like a natural fit for a blog that focuses on divorce and family law. But in many ways, Nora Ephron was not just any filmmaker.

Ephron, who died last Tuesday at 71, is an important cultural figure because, though her books, essay collections and movies, she helped change the way our society thinks about marriage, divorce and relationships between men and women. The fact that we no longer see divorce as a tragedy is in part thanks to her work, much of which was probably very popular here in New Jersey.

CDC reports new statistics in marriage, divorce

Although the median age for first marriages has increased for both men and women, the divorce rate has remained relatively constant in recent years, according to a new report from the U.S. Centers for Disease Control and Prevention (CDC). This likely means that people are still entering into long-term relationships at a relatively early age, but are simply waiting to get married, with more or less the same effects on their future marriage.

This is just one of the many interesting trends that were uncovered by the CDC report, which includes information from nearly 23,000 Americans between the ages of 15 and 44 who were surveyed between 2006 and 2010. In addition, researchers compared the results from multiple earlier surveys dating back to the 1970s.

Cohabitation may no longer correlate with increased divorce rate

For several decades, researchers and family law attorneys associated cohabitation before marriage with an increased likelihood of eventual divorce. However, according to a new marriage survey of about 22,000 women and men in New Jersey and across the country, it seems that the long-held belief may no longer be accurate.

Interestingly, the study results indicated a clear distinction between couples who lived together while engaged or with the express intent of getting married in the near future, and couples who lived together with no solid plans to marry. The former group was much less likely to divorce than the latter, which researchers believe has much to do with commitment and shared goals.

Young men perceive family law courts as biased

A recent study of 5,200 people cited in Time magazine found that while roughly the same number of men wished to get married as women, men between the ages of 25 and 49 desired marriage less than women in the same age range.

While this could be for a variety of reasons, many men said they are hesitant to divorce in what they claim is a family law system that is weighed heavily in favor of women.

In most cases, New Jersey law requires courts to distribute marital property equitably without regard to gender, but many men still avoid marriage because they see the chance of divorce as a financial risk. Young men with strong careers and those who started their own businesses are especially afraid that divorce could make them give a large portion of their assets away, despite the hard work they put in to get them.
